By accessing or using NiaApp ("the Service"), operated by Dcrayons, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

NiaApp is an AI-powered marketing automation platform that enables businesses to automate customer conversations across WhatsApp, Facebook Messenger, and Instagram Direct; run WhatsApp marketing campaigns; and create and manage Facebook and Instagram advertising campaigns.

Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Subscription & Payments

• NiaApp offers paid subscription plans (Starter, Growth, Enterprise)
• Payments are processed securely through Stripe and Razorpay
• Subscriptions renew automatically at the end of each billing period
• You may cancel your subscription at any time from your account settings
• Refunds are handled on a case-by-case basis — contact us for refund requests
• We reserve the right to change pricing with 30 days advance notice

Acceptable Use

You agree not to:

• Send spam, unsolicited messages, or bulk messages to non-opted-in recipients
• Use the Service for any illegal or unauthorized purpose
• Violate Meta's (Facebook, Instagram, WhatsApp) Platform Terms or Community Standards
• Impersonate any person or entity
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service to collect data beyond what is necessary for legitimate business purposes
• Circumvent platform rate limits or usage restrictions

Third-Party Integrations

NiaApp integrates with Meta's platforms (Facebook, Instagram, WhatsApp). Your use of these integrations is also subject to Meta's Terms of Service and Platform Policies. We are not responsible for changes to third-party APIs or policies that may affect service availability.

Intellectual Property

NiaApp and its original content, features, and functionality are owned by Dcrayons and are protected by applicable intellectual property laws. Your content (knowledge bases, campaigns, contacts) remains your property. By using the Service, you grant us a limited license to use your content solely to provide and improve the Service.

Limitation of Liability

To the maximum extent permitted by law, NiaApp and Dcrayons shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of revenue, data, or business opportunities.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or Meta's platform policies. Upon termination, your right to use the Service will immediately cease, and we will delete your data in accordance with our Privacy Policy.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
